Privacy Policy

This Privacy Policy applies to personal information that is processed by Carbon, Inc. and our Affiliates (“Carbon”, “we”, and “us”) in the course of our business, including personal information we collect online, when you use our websites (“Sites”), and as a result of our providing our products and related services, the HTML-formatted email messages that we send to you and other hyperlinks that link to this Privacy Policy, other communications and through our offline interactions (e.g., if you visit Carbon offices or register for, attend or participate in Carbon’s events, webinars or contests) (collectively, the “Services”).

This Privacy Policy is also incorporated into and is subject to the Terms of Use located in the footer of this Site (the “Terms”), and capitalized terms used, but not defined in this Privacy Policy have the meanings given to them elsewhere in the Terms.

If you have entered into a Subscription Agreement or other agreement with Carbon, the Subscription Agreement or such other agreement governs the proprietary business information we receive through your use of our products. Please review the Subscription Agreement or such other agreement for more information. This Privacy Policy also covers the use and disclosure of information we collect from you offline. By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes.

This Privacy Policy does not govern or apply to information collected and processed by Carbon in connection with employment, an Independent Contractor relationship or an application for employment with Carbon. Please refer to the Privacy Notice to Carbon’s Employees, Contractors and Job Applicants here and in our Careers page.

1. The Information Carbon Collects:

1.1 PERSONAL INFORMATION

“Personal Information” is information that identifies you as an individual or relates to an identifiable individual, such as name, address, telephone number, e-mail address, job title and company, username/user ID, IP address, or images and related metadata (for example, when visiting our offices or attending an event).

  • Through the Services: When using the Services, such as when you sign up to receive a newsletter or other information, submit comments or questions, register for an account, contact us (by email, phone, and online chats), or order or use products or services through or in connection with the Services, including your use of Carbon products that may communicate with the Services, you provide Personal Information to Carbon.
    When you purchase a Carbon product through our Site, we will collect your Personal Information to process and complete the purchase, except that if you elect to purchase a Carbon product from the authorized reseller option indicated in our Site, you will enter into a separate agreement with such authorized reseller and will be subject to the privacy policy and terms of service of such authorized reseller with respect to such purchase, in addition to this Privacy Policy and our Terms.
  • Offline Information: We collect Personal Information from you offline, e.g., when you place an order over the phone, contact us in a trade show or promotional event, participate in a Carbon event, visit our offices, or contact our Services team.
  • Information from Other Sources: We also obtain information, including Personal Information, from third parties and sources other than the Services, such as third parties who market, sell, support or otherwise provide products or services relating to the Services, including, commercial data sources, reseller(s), social media platforms, conferences and events, or publicly available databases such as LinkedIn.

We need to collect Personal Information in order to provide the requested Services to you. If you do not provide the information requested, we may not be able to provide the Services. If you disclose any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

1.2 OTHER INFORMATION

“Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual:

  • “Cookies” Information: When you use the Sites or Services, we send one or more cookies – small text files containing a string of alphanumeric characters – to your computer. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences, and other traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, to enhance our sales process and pipeline, and to personalize your experience. We also gather statistical information about use of the Services in order to continually improve design and functionality, understand how our services are used, and assist us with resolving questions regarding them. Cookies further allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are using the Services. We may also use cookies or other technologies in online advertising to track responses to our offers. Carbon also permits third parties to place cookies on the Services.
    Carbon may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Services. Persistent cookies can be removed. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. You may also wish to refer to http://www.allaboutcookies.org/manage-cookies/index.html. Please note that if you delete, or choose not to accept, cookies from the Services, you may not be able to utilize the features of the Services to their fullest potential. You also may not receive advertising or other offers from us that are relevant to your interests and needs. The Sites and Services do not currently support technology to respond to “do-not-track” browser signals, or other mechanisms to exercise choice regarding the collection of information about users’ online activities over time and across third-party websites or online services.
  • Analytics: We use third-party analytics services like Google Analytics, which use cookies and similar technologies to collect and analyze information about use of our Services and report on activities and trends. These third-party analytics services may also collect information regarding the use of other websites, apps and online resources.   • “Automatically Collected” Information: When you use the Services, we may automatically record certain information from our products or your web browser by using different types of technology, including “clear gifs” or “web beacons.” We use this information to measure the success of our marketing campaigns, and compile statistics about usage of the Services and response rates. This “automatically collected” information may include Internet Protocol address (“IP Address”) or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after the Services, the pages you view on the Services, support status, usage statistics and other information regarding your use of our products and the dates and times that you visit, access, or use the Services. We use this information to ensure that the Services function properly, including calculating usage levels, diagnosing server problems and administering the Services. We may also derive your approximate location from your IP address.

2. How and Why Carbon Uses Personal Information:

Where allowed under applicable law, Carbon relies on our legitimate business purposes to process Personal Information about you in a variety of ways for, such as:

  • To provide the functionality of the Services and fulfilling your requests: Carbon uses the Personal Information you provide or that we collect, to operate, maintain, enhance, and provide all the features and services found on the Services, including processing purchases, orders, returns/exchanges or responding to requests for information, samples or services.
  • To provide you with marketing communications to advertise our Services via email messages with advertisements and product or company information that may be selected based in part on your Personal Information (to the extent not covered by your consent).
  • To analyze such Personal Information for business reporting and providing personalized services: Carbon uses the Personal Information that you provide to understand and analyze the usage trends, interests, and preferences of our users, to improve the way the Services work and look, to better understand you so that we can personalize the Services and our interactions with you, and to create new features and functionality.
  • To conduct data analysis, for example, to improve the efficiency of our Services; for audits, to verify that our internal processes function as intended and are compliant with legal, regulatory or contractual requirements; for fraud and security monitoring purposes, for example, to detect and prevent cyberattacks or attempts to commit identity theft; for developing new products and services; and for enhancing, improving, or modifying our current products and services.
  • To identify usage trends, for example, understanding which parts of our Services are of most interest to users; for determining the effectiveness of our promotional campaigns, so that we can adapt our campaigns to the needs and interests of our users; and for operating and expanding our business activities.
  • Aggregating and/or anonymizing Personal Information: Carbon may aggregate and/or anonymize Personal Information so that it will no longer be considered Personal Information. We do so to generate other data for our use, which we may use to operate, protect, make informed decisions, and report on the performance of our business and disclose for any purpose.

We process Personal Data to provide personalized services with your consent, such as:

  • To provide you with marketing communications and facilitate social sharing: Various aspects of the Services and email messages we send you in connection with your use of the Services or to advertise our Services, will include relevant advertisements and product or company information that may be selected based in part on your Personal Information, including your preferences and usage patterns within the Services.
    You can unsubscribe from receiving these marketing communications at any time. To unsubscribe, click the email footer “Unsubscribe” link or contact us at privacy@carbon3d.com to edit your email notification preferences. You may not opt-out of receiving non-promotional messages regarding your Carbon account, such as technical notices, purchase confirmations, or Service-related emails.
  • To fulfill your orders or respond to your requests for information or samples, and other inquiries.
    For example, to satisfy your requests for Carbon materials such as marketing collateral, samples, or white papers, we collect and use your name and email address.
  • To contact you for administrative purposes, for customer service or product support purposes, or to allow you to send messages to another person if you choose to do so.
  • To allow you to participate in promotions: We may offer you the opportunity to participate in a sweepstakes, contest, surveys, polls or other promotion or testimonials, and use Personal Information to administer such promotions and events. Some of these promotions have additional rules containing information about how we will use and disclose your Personal Information.
  • To invite you to participate on customer advisory boards or in surveys, studies, and assessments of offerings.
  • To allow you to register to participate on advisory boards or to request feedback from you about Carbon Services. We use your feedback to fulfill our legitimate interest in improving our Services and pursuing our business. Your participation would be voluntary and subject to the terms of your agreements with us and this Privacy Policy.

We process Personal Information to manage our contractual and pre-contractual business relationship with you, enter into business relationships with prospective customers and perform the respective contractual obligations, such as:

  • Creating and managing your Carbon Academy account and corresponding credentials.
  • Conducting accounting, auditing and billing activities.
  • Processing a payment, communicating regarding such payments, and related customer services.
  • Fulfilling an order placed on a Site (when such option is offered in the Site)

We use Personal Information to comply with laws.

  • We may use your Personal Information to comply with any applicable law, regulation, legal process, or governmental request, or to protect our legal rights or those of others.

3. When and Why Carbon Discloses Personal Information:

3.1 WE DISCLOSE YOUR PERSONAL INFORMATION:

  • To our affiliates for the purposes described in this Privacy Policy: You can consult the list and location of our affiliates here https://docs.carbon3d.com/files/legal/affiliates.pdf. Carbon, Inc. is the party responsible for the management of the jointly-used Personal Information.
  • When you elect to disclose Personal Information by using the Services: Any Personal Information that you voluntarily choose to share with another user or third party through the Services, or in a publicly accessible area on the Services, will be available to others who access that content.
  • To our third-party service providers: Carbon works with third-party service providers to provide for the provision of products pursuant to other agreements that we may have with you, register or enroll users for newsletters, accounts or other Services, manage mailing lists, provide newsletters or other information to users for Carbon, and provide website and application development, hosting, and maintenance as well as other services for us.
  • To our authorized reseller, if you elect to purchase a Carbon product through the reseller option indicated in our Sites, in which case you will enter into a separate agreement with such authorized reseller and will be subject to the privacy policy and terms of service of such reseller with respect to the purchase process, in addition to our processing under this Privacy Policy.
  • To third-party sponsors of sweepstakes, contests and similar promotions.
  • To our business partners for purposes of providing you with joint marketing offers.
  • To third-party printing partners: If you agree or request that we connect you to one of our third-party printing partners to assist with your printing project, we will share your contact and other information provided by you with that printing partner so that they can contact you about your project.

3.2 CARBON’S OTHER USES AND DISCLOSURES OF PERSONAL INFORMATION:

We also use and disclose your Personal Information as necessary or appropriate, especially when we have a legal obligation or legitimate interest to do so.

  • To comply with applicable law, respond to requests from public and governmental authorities, and to cooperate with law enforcement: Carbon discloses your information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws (such as U.S. Copyright law), which can include laws outside your country of residence. We also disclose your information in response to requests from public and governmental authorities, such as a court order, judicial or other government subpoena or warrant, to cooperate with investigative or law enforcement activity, or to provide information we think is important. These can include authorities outside your country of residence.
  • For other legal reasons: Carbon also discloses your information that we believe, in good faith, is appropriate or necessary to take precautions against liability; to protect Carbon and others from fraudulent, abusive, or unlawful uses or activity; to investigate and defend ourselves against any third-party claims or allegations; to enforce our terms and conditions; to protect the security or integrity of the Services; or to protect the rights, property, security, and/or safety of Carbon, our users, or others.
  • In connection with a sale or business transaction: Carbon has a legitimate interest in disclosing or transferring your Personal Information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with bankruptcy or similar proceedings). Such third parties may include, for example, an acquiring entity and its advisors.

3.3 CARBON’S USES AND DISCLOSURES OF OTHER INFORMATION:

We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then we may use and disclose it for the purposes for which we use and disclose Personal Information as detailed in this Privacy Policy. In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.

4. Your Choices and Access:

You have the ability to opt-out of receiving marketing communications, either through links provided at the bottom of such messages or by submitting a request to privacy@carbon3d.com.

To the extent required by applicable law, you may request to review, correct, update, suppress, restrict or delete Personal Information that you have previously provided to Carbon, or you may request to receive an electronic copy of your Personal Information for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), by submitting a Request Form, calling +1 (888) 344-3009 or sending an email to privacy@carbon3d.com. Carbon will process your request in accordance with any applicable laws and our policies and procedures for dealing with such requests.

In your request, please make clear what Personal Information you would like to have changed, whether you would like to have your Personal Information suppressed from our database or otherwise let us know what limitations you would like to put on our use of your Personal Information. For your protection, Carbon may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

Please note that Carbon may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Information provided until after the completion of such purchase or promotion).

4.1 RETENTION PERIOD:

We retain Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law.

The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide the Services to you (for example, for as long as you have an account with us or keep using the Services);
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

4.2 THIRD-PARTY SERVICES:

The Services contain references and links to Web sites and services provided by third parties.

Any Personal Information you provide on third-party sites or services is provided directly to that third party and is subject to that third party’s policies governing privacy and security. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links are displayed on the Services. We encourage you to learn about third parties’ privacy and security policies before providing them with Personal Information.

Some features of the Services are provided by third parties. This includes sharing on social networks, online store functions and other features. Information you provide to such third parties (including when using these features on our Sites) is not governed by this privacy policy. We encourage you to review the privacy policies of third-party services before using them.

We may use a third-party payment service to process payments made through the Services or offer the option to purchase certain Carbon products through an authorized reseller identified in the Site. If you wish to make a payment through the Services or elect to purchase a Carbon product through such reseller, your Personal Information will be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your Personal Information.

4.3 THIRD-PARTY ADVERTISING:

We may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services.

You may receive advertisements based on information relating to your access to and use of the Services and other websites or online services on any of your devices, as well as on information received from third parties. These companies place or recognize a unique cookie on your browser (including through the use of pixel tags). They also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. 4.4 CHILDREN’S PRIVACY:

Carbon does not knowingly collect or maintain Personal Information from persons under 16 years of age, and no part of the Services is directed to persons under 16. If you are under 16 years of age, then please do not use or access the Services at any time or in any manner. If Carbon learns that Personal Information of children under the age of 16 has been collected on the Services without verifiable parental consent, then Carbon reserves the right to take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 16 has obtained an account on the Services, then you may alert Carbon at privacy@carbon3d.com and request that Carbon delete that child’s Personal Information from its systems.

4.5 DATA SECURITY:

While we seek to employ reasonable limited physical, managerial, and technical safeguards designed to help improve the integrity and security of your Personal Information, no physical or technical system, process, transmission, or storage mechanism is completely secure or immune from outages, losses, attacks, circumvention, design or implementation flaws, and human error. Therefore, we cannot and do not ensure or warrant that information you transmit to Carbon will not be lost or compromised, either during or after transmission. Do not provide your personal information if you are concerned with its disclosure.

4.6 SENSITIVE INFORMATION:

We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, sexual orientation, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Services or otherwise to us.

4.7 INTERNATIONAL VISITORS AND CROSS-BORDER TRANSFERS:

If you interact with Carbon or provide your Personal Data to us, your Personal Information may be transferred to, stored and processed on servers or databases located in any country where we operate or in which we engage service providers, and by using our Services you understand that your information will be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Information.

If you are located in the European Economic Area (“EEA”), United Kingdom or Switzerland: Some of the non-EEA countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (the full list of these countries is available here: https://ec.europa.eu/info/law/law-topic/data-protection/data-transfers-outside-eu/adequacy-protection-personal-data-non-eu-countries_en). Our relationship with you. With respect to individuals located in the EEA, United Kingdom, or Switzerland We are the “controller” with respect to your Personal Information because we determine the means and purposes of processing your information when using our Services. Any third parties that handle your Personal Data in accordance with Carbon’s instructions are Carbon’s service providers and are “data processors.”

4.8 CHANGES AND UPDATES TO THIS PRIVACY POLICY:

Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which may be revised periodically at Carbon’s sole discretion, as provided in the Terms. If we modify the Privacy Policy, we will make it available through the Services, and indicate the date of the latest revision.

Our amended Privacy Policy will take effect after it is made available through the Services. Your continued use of the Services after revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.

5. California Consumer Privacy Act Notice

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), we are providing the following additional details regarding the categories of Personal Information about California residents that we have collected or disclosed within the preceding 12 months:

  1. We disclosed the following Personal Information to third parties such as our affiliates and members of our production network for our operational business purposes:

For purposes of this Privacy Policy, “sold” or “sale” means the disclosure of Personal Information for monetary or other valuable consideration but does not include, for example, the transfer of Personal Information as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business.

In some instances, we may decline to honor your request where an exception applies, such as where the disclosure of Personal Information would adversely affect the rights and freedoms of another California resident.

Requests for deletion or access to personal information are subject to our ability to reasonably verify your identity in light of the information requested and pursuant to relevant CCPA requirements, limitations, and regulations. We will verify you by requiring you to respond to an email from us sent to the email address that we have for you.

To authorize an agent to make a request to disclose, delete, or opt out on your behalf, please send a written authorization signed by you and the authorized agent to us via the contact information provided in the “Carbon Contact Information” section.

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.
